1. About Us

Vitalia's Pizza on Wheels ("we", "us", "our") is a business operated by The Trustee for Lo Conte Family Discretionary Trust (ABN 69 279 967 941), a discretionary trading trust registered in Queensland, Australia.

By accessing our website, requesting a quote, making a booking, or using our services, you agree to these Terms & Conditions.

2. Quotes and Bookings

All quotes provided by Vitalia's Pizza on Wheels are subject to availability and do not constitute a confirmed booking.

A booking is only confirmed once the required payment has been received and written confirmation has been issued by us.

Before a booking is confirmed, we reserve the right to decline any booking request at our discretion.

By making a booking, you confirm that you are authorised to enter into this agreement.

3. Payment Terms

Events Scheduled Within 3 Weeks

For events taking place within 3 weeks of the booking date, full payment is required at the time of booking.

Events Scheduled More Than 3 Weeks Away

For events taking place more than 3 weeks from the booking date, clients may choose to:

• Pay 100% of the event cost at the time of booking; or
• Pay a 30% deposit to secure the booking.

The remaining balance must be paid no later than 3 weeks before the event date.

Failure to make payment by the due date may result in cancellation of the booking in accordance with our Cancellation & Refund Policy.

3a. Travel and Evening Surcharges

Travel: Service within 25 kilometres of Cairns is included at no extra cost. For venues beyond this radius, a travel surcharge applies based on distance from Cairns. The applicable surcharge, if any, is calculated automatically from the postcode entered at booking and shown clearly during the online booking process before payment.

Evening events: Events with a start time of 7:00pm or later attract a flat evening staff surcharge, shown at checkout before payment.

All applicable surcharges are included in the total shown at checkout and form part of the event price, payable in line with the payment terms above.

4. Promotional Discounts

From time to time, we may offer promotional codes, discounts, referral offers, or special promotions.

Discounts cannot be combined unless explicitly stated.

Promotional offers have no cash value and cannot be exchanged for cash or credit.

5. Event Requirements

The client is responsible for ensuring reasonable access to the event location and providing accurate information regarding the event.

The client is responsible for obtaining any permissions, approvals, permits, or venue authorisations required for the event location. For events held on private property, no additional permits are generally required. For events held in public spaces, parks, or council-managed land, the client is responsible for obtaining any relevant council or authority approvals prior to the event date.

Any significant changes to guest numbers, location, timing, or event requirements should be communicated as soon as possible.

We reserve the right to adjust pricing where substantial changes affect the scope of the booking. Any price adjustment will be communicated before the booking proceeds.

5a. Technical Requirements

Power supply: A standard 10-amp power outlet located within 20 metres of the truck's set-up position is required. We supply our own 20-metre extension lead. The client must ensure the outlet is accessible, safe, and in working order prior to our arrival. If no suitable power outlet is available, we reserve the right to cancel the booking with a full refund.

Access and space: The truck requires a clear, flat, hard-standing surface (such as concrete, pavers, or asphalt) measuring approximately 4 metres wide by 5 metres long. A minimum height clearance of 2.5 metres is required above the set-up area. The client is responsible for ensuring vehicle access to the set-up location is available and unobstructed at the agreed arrival time.

Set-up confirmation: Access requirements will be reviewed as part of the booking process. If conditions at the venue differ materially from those confirmed at booking (including but not limited to power access, surface type, or clearance), we reserve the right to adjust the set-up or, where the event cannot proceed safely, to cancel with a full refund.

6. Food Allergies and Dietary Requirements

Clients are responsible for notifying us of any allergies, intolerances, coeliac requirements, or dietary requirements before the event.

We take reasonable care when preparing and serving food and will provide information about allergens where requested or where relevant to the booking.

However, due to the nature of food preparation and mobile catering, we cannot guarantee that any item is completely free from allergens or traces of allergens.

7. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights, guarantees, or remedies that cannot be excluded under the Australian Consumer Law or any other applicable law.

8. Limitation of Liability

To the maximum extent permitted by Australian law, Vitalia's Pizza on Wheels shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our website or services.

This limitation does not apply to liability that cannot be excluded under Australian law.

9. Website Content

All content, text, photographs, logos, branding, graphics, and other materials displayed on this website remain the property of Vitalia's Pizza on Wheels unless otherwise stated.

No content may be copied, reproduced, or distributed without prior written permission.

10. Third-Party Services

We may use third-party providers, including payment processors such as Stripe or Square, to process payments securely.

We do not store credit card information on our systems.

11. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any disputes arising from these Terms or our services shall be subject to the jurisdiction of the courts of Queensland.
